Canngea Pty Ltd issued infringement notices totalling $59,400 for alleged failure to comply with a request for information about the supply of therapeutic vaping goods

In March 2026, the Therapeutic Goods Administration (TGA) issued 3 infringement notices totalling $59,400 to Queensland-based company Canngea Pty Ltd. 

The notices were issued for failing to comply with requests to provide information about the supply of therapeutic vaping goods, in alleged breach of conditions of exemption applicable to the goods. 

Canngea Pty Ltd has agreed to pay the infringement notices.

Therapeutic vapes for smoking cessation and the management of nicotine dependence are only available for sale from participating pharmacies, where clinically appropriate. As unapproved goods, therapeutic vaping goods are not subject to pre-market evaluation or approval by the TGA but must comply with specified requirements under the Therapeutic Goods Act 1989 (Cth) (the Act). 

Under the Act, sponsors of therapeutic vaping goods must retain and on request provide certain information to the TGA. The information must be provided in a specified form and within a specified timeframe. This includes information relating to supply, and it is an offence to provide information that is false or misleading. These requirements support the TGA’s post-market monitoring and compliance activities. 

The TGA reminds sponsors of therapeutic vaping goods that they are responsible for understanding and complying with their regulatory obligations under the Act before notifying the goods to the TGA or engaging in related commercial activities. 

Non-compliance may result in regulatory action, including infringement notices, a determination to cease supply of the therapeutic vaping goods, or other enforcement action including civil or criminal proceedings. The TGA takes regulatory action where non-compliance is identified, in line with its compliance framework. 

This action reflects the TGA’s ongoing compliance and enforcement activities for therapeutic goods, including vaping goods, as outlined in the TGA’s Compliance Principles 2026 and 2027.
