Man fined for alleged importation and advertising of unapproved therapeutic goods

In January 2019, the Therapeutic Goods Administration (TGA) issued an individual two infringement notices for the alleged importation and advertising of unapproved performance and image enhancing products.

During the course of a TGA compliance operation, the alleged importation was detected and the TGA conducted an investigation, which involved executing a search warrant at the individual’s residence.

The TGA takes action against illegal activity

The TGA investigates suspected illegal activity relating to therapeutic goods.

In the interest of public health and safety, the Therapeutic Goods Act 1989 (Cth) prohibits the import, export, manufacture, supply and advertising of unapproved therapeutic goods for human use, which have not been subject to approvals, exemptions, or permits.

The TGA oversees the regulation of therapeutic goods used in Australia, and implements a range of enforcement remedies to address non-compliance, including seizure and destruction of unapproved therapeutic goods, fines and court proceedings.

Be aware and report illegal activity to the TGA

Consumers should be aware of unapproved medicines and medical devices, including illegal performance and image enhancing products. There are serious risks when using medicines and devices that have not been assessed by the TGA for safety and quality, and have not been recommended or prescribed by a medical professional. These products may:

• include dangerous ingredients not listed on the label
• be contaminated
• cause severe adverse events
