Suryam Energy Pty Ltd paid infringement notices totalling $39,600 for alleged unlawful supply of vaping goods

In August 2026, the Therapeutic Goods Administration (TGA) issued two infringement notices totalling $39,600 to New South Wales-based company Suryam Energy Pty Ltd (Suryam Energy) for the alleged unlawful supply of vaping goods.

The TGA received reports from members of the public that vaping goods were being supplied at a service station operated by Suryam Energy in the Wandandian area. Following an investigation by the TGA into the allegations, two infringement notices were given for the alleged unlawful supply of vaping goods. Both infringement notices were paid in full in September 2026.

It is illegal for general retailers, including tobacconists, convenience stores and service stations, to sell any vaping goods. Therapeutic vapes for smoking cessation or the management of nicotine dependence are only available for sale from participating pharmacies, where clinically appropriate.

The TGA is committed to protecting Australians from unsafe and unlawful vaping goods while ensuring legitimate patient access to therapeutic vaping goods in pharmacy settings. The TGA takes all allegations of non-compliance seriously.

Non-compliance may result in regulatory action, including infringement notices or other enforcement action including civil or criminal proceedings, in line with the TGA's compliance framework.

This action reflects the TGA's ongoing commitment to detect, deter and disrupt the unlawful supply of therapeutic goods and vaping goods, as outlined in the TGA's Compliance Principles 2026 and 2027.
