Elixir Compounding Pharmacy and Elixir Centre for Wellness issued infringement notices for the alleged unlawful advertising of therapeutic goods

The Therapeutic Goods Administration (TGA) has issued 3 infringement notices totalling $59,400, to Victorian-based companies Elixir Compounding Pharmacy Pty Ltd (Elixir Compounding Pharmacy) and Elixir Centre for Wellness Pty Ltd (Elixir Centre for Wellness). 

The notices were issued for the alleged unlawful advertising of therapeutic goods, in contravention of the Therapeutic Goods Act 1989 (the Act).

Both companies paid the infringement notices in August 2025.

It is alleged that Elixir Compounding Pharmacy advertised palmitoylethanolamide capsules and gamma-aminobutyric acid capsules on its website. The advertisements included references to serious conditions such as depression and fibromyalgia. These references are considered prohibited and restricted representations under the Act and are not permitted in advertising for therapeutic goods without prior approval or permission from the TGA. 

It is further alleged that Elixir Centre for Wellness advertised prescription-only medicines, being an intravenous iron infusion product, on its website. The advertising of prescription-only medicines directly to the public is prohibited under the Act.

Advertising prescription medicines directly to the public can create inappropriate demand and undermine the relationship between patients and their treating health practitioners. Decisions about appropriate treatment options should be made by a health professional in consultation with their patient.

Pharmacies, including those offering compounding services, are responsible for understanding their legal obligations under the Act before advertising or supplying therapeutic goods. The TGA has recently updated its guidance on advertising health services, which includes information on the promotion of compounding services.

The TGA will take enforcement action where serious non-compliance with the Act is identified in accordance with our regulatory compliance framework. This may include issuing infringement notices, directions and prevention notices, or civil or criminal proceedings.
