Dispensed Pty Ltd issued infringement notices and directed to cease alleged unlawful advertising of medicinal cannabis

The Therapeutic Goods Administration (TGA) has issued 6 infringement notices, totalling $118,800, and a direction notice to Dispensed Pty Ltd (Dispensed) for the alleged unlawful advertising of medicinal cannabis in contravention of the Therapeutic Goods Act 1989 (the Act).

Dispensed paid the 6 infringement notices in September 2025.

It is alleged that Dispensed unlawfully advertised prescription-only medicinal cannabis to the public on third-party websites and social media platforms. The advertising included indirect references to medicinal cannabis, using terms such as ‘plant medicine’ and ‘cannabinoid-based therapies’ which are not permitted under the Act.

The Act prohibits the advertising of prescription medicines, including medicinal cannabis, to the public. Such advertising can create inappropriate demand for these medicines and undermine the relationship between a patient and their treating health practitioner. Appropriate treatment options should be determined by a health professional in consultation with their patient.

The direction notice requires Dispensed to:

• cease all advertising of medicinal cannabis, including on platforms managed by third parties
• recover any printed advertising material still in circulation, such as fliers and posters
• report evidence of compliance with the direction to the TGA.

Health services that advertise or supply therapeutic goods to the public are responsible for understanding their legal obligations under the Act. This applies even when advertising is carried out by third parties on behalf of a business.

The TGA website provides guidance to help businesses involved with medicinal cannabis products or related health services understand their obligations and avoid unlawfully advertising these products to consumers, including through promotion of the business or service.

The TGA will continue to take enforcement action where serious non-compliance with the Act is identified in accordance with our regulatory compliance framework. This may include issuing infringement notices, directions and prevention notices, or civil or criminal proceedings.
