Booty N Buff Nutrition issued infringement notices for the alleged unlawful advertising of sports supplements

The Therapeutic Goods Administration (TGA) has issued 2 infringement notices totalling $37,560 to Booty N Buff Nutrition Caringbah Pty Ltd (Booty N Buff Nutrition) for the alleged unlawful advertising of therapeutic goods in contravention of the Therapeutic Goods Act 1989 (the Act).  

Booty N Buff Nutrition paid the infringement notices in December 2025.

It is alleged that Booty N Buff Nutrition unlawfully advertised sports supplements that were not included in the Australian Register of Therapeutic Goods (ARTG) which contained the Schedule 4 prescription-only substances tryptophan and levodopa.

Therapeutic goods not entered in the ARTG have not been assessed for their quality and safety by the TGA and may pose a health risk.

In Australia, Schedule 4 substances are classified as prescription-only due to the risk of harm and the level of access control required to protect public health and safety. The decision to use a particular prescription-only medicine should be made between the prescribing health practitioner and the patient based on informed consent, including a discussion about possible side effects. Advertising prescription-only medicines directly to consumers is prohibited under the Act. 

Businesses must understand their legal obligations under the Act before manufacturing, supplying or advertising therapeutic goods. Consequences for non-compliance may include infringement notices, direction notices, or civil or criminal proceedings. 

The TGA will continue to take action where serious non-compliance with the Act is identified in accordance with our regulatory compliance framework.
