The product names do not comply with subsection 7(1) of TGO 110 because the
terms “VooPoo” and “GeekVape” could be attractive to children or adolescents,
while “VooPoo” could also imply health benefits, including healing.
Conditions imposed
1. During the consent period, the Goods must conform with each standard
applicable to the Goods, except subsection 7(1) of TGO 110 on the basis of the
use of the name “VooPoo” or “GeekVape”.
2. Pesamic must take every reasonable effort to ensure that, at the conclusion
of the consent period, no stock of the Goods is available for retail supply, or
otherwise within the retail or wholesale supply chains in Australia.
3. During the consent period, the Goods must continue to comply with all other
legislative requirements.
