THERAPEUTIC GOODS ACT 1989

THERAPEUTIC GOODS REGULATIONS

I, CRAIG DAVIES, Head - Advertising and Export Section, Non-Prescription Medicines Branch, Therapeutic Goods Administration and delegate of the Secretary to the Department of Health and Ageing for the purposes of Section 42DF(1) of the Therapeutic Goods Act 1989, give notice that the restricted representations described in paragraph (a) below, have been approved for use in advertisements directed to pharmacy assistants, for the products listed in paragraph (b) provided the condition identified in paragraph (c) is met:

1. Representations to the effect that advertisements to pharmacy assistants for the goods described in paragraph (b) may refer to:
   "If a customer answers 'yes' to any of these questions, you should refer them to the pharmacist:

   • Does your customer have any medical conditions such as asthma, bronchitis or emphysema?
   • Does your customer suffer from high blood pressure or heart disease?
   • Does your customer suffer from glaucoma, diabetes or thyroid disease?
   • Does your customer have a prostate condition, or alternatively are they pregnant or breastfeeding?"

   "If your customer has asthma, bronchitis or emphysema, high blood pressure, heart disease, diabetes, thyroid disease, a prostate condition, glaucoma, is pregnant or breastfeeding, or is taking any other medications, a decongestant may not be suitable, and they should be referred to a pharmacist".

3. Subject to the condition that the publication and distribution of any advertisements which include the above restricted representations are limited to pharmacy assistants only.
