If the Secretary of the Department of Health, Disability and Ageing believes, on reasonable grounds, that a person is not complying with the Therapeutic Goods Act 1989 (the Act) or an instrument made under this Act in relation to particular goods and it is in the interests of public health or safety, the Secretary may issue a notice of enforceable directions to that person to take steps to address non-compliance. These steps may include (but are not limited to) re-labelling the goods or destroying the goods.
Failure to comply with the notice of enforceable directions may result in further actions, such as commencing court proceedings.
